Online Shopping Fraud in Pakistan: How to Take Legal Action

You placed an order online, paid your money, and either received nothing — or received something completely different from what was advertised. The seller has stopped responding or blocked you. Everyone around you says: “Online se hota hai yeh sab. Kuch nahi ho sakta.” This is completely wrong. Pakistan has consumer protection laws, and as a consumer, you have legal rights that can be enforced.


⚖️ 1. The Legal Framework

Consumer protection in Pakistan is governed by a combination of federal and provincial laws:

  • Punjab Consumer Protection Act, 2005
  • Sindh Consumer Protection Act, 2014
  • KPK Consumer Protection Act, 1997
  • Prevention of Electronic Crimes Act (PECA), 2016 — for online fraud and cybercrime
  • Pakistan Penal Code (PPC) — Sections on fraud, cheating, and criminal breach of trust

📋 2. Your Rights as an Online Consumer

Under Pakistani consumer protection laws, you have the following rights:

  • The right to receive what was advertised — misleading advertisements are a violation
  • The right to a refund or replacement for non-delivery of paid goods
  • The right to a refund or replacement for defective, damaged, or counterfeit products
  • The right to take legal action against fraudulent sellers
  • The right to file a complaint with the FIA for online fraud and cybercrime

🧭 3. Step-by-Step: How to Take Legal Action

Step 1: Document Everything — Immediately

Before doing anything else, preserve your evidence. This is the most important step.

  • Screenshot the product listing before the seller can delete or edit it
  • Save all WhatsApp messages, DMs, and chat history with the seller
  • Screenshot your payment confirmation — bank transfer, JazzCash, Easypaisa, credit card receipt
  • Note the order date, amount paid, seller’s account name, phone number, and social media handle
  • If you received a wrong or defective product — photograph it immediately

Step 2: Send a Formal Written Complaint to the Seller

Send a clear, written message via WhatsApp or email stating:

  • That you placed an order and paid on a specific date
  • That you have not received your order / received the wrong item
  • That you are demanding delivery of the correct product or a full refund
  • Give a 48-hour deadline for response

Save a screenshot of this message. This creates a formal paper trail and demonstrates that you attempted to resolve the matter before escalating.

Step 3: File a Consumer Court Complaint

Consumer Courts in Pakistan handle small claims quickly and efficiently. You do not always need a lawyer for small amounts. File a complaint with your city’s Consumer Court stating the facts, attaching your evidence, and claiming your refund or compensation.

Step 4: File an FIA Cybercrime Complaint

If the matter involves clear online fraud — a seller who took payment and disappeared, or operated a fake business — file a complaint with the FIA Cybercrime Wing.

  • Always pay through traceable methods — bank transfer, JazzCash, Easypaisa — not cash on pickup from an unknown seller
  • Prefer cash on delivery for unknown online sellers until trust is established
  • Check seller reviews and ratings before ordering
  • Never delete your chat history until the matter is fully resolved
  • For large purchases, always deal with registered businesses with a verifiable address
