But the law provides clear remedies. Here is exactly what to do if someone files a false FIR against you in Pakistan.

⚖️ 1. Legal Framework

• Code of Criminal Procedure, 1898 (CrPC) — governing FIR registration and criminal procedure
• Pakistan Penal Code, 1860 (PPC) — Sections 182, 211 on false complaints and false charges
• Section 561-A CrPC — allowing High Courts to quash FIRs
• Section 497 CrPC — bail provisions
• Article 199 of the Constitution — High Court’s writ jurisdiction

🚨 2. First Steps — Do This Immediately

Step 1 — Do not panic or flee. Running away or going into hiding makes you look guilty and makes securing bail harder. Stay calm and take legal steps immediately.

Step 2 — Get a copy of the FIR. Under Pakistani law, you have the right to obtain a copy of the FIR. You or your advocate can collect it from the relevant police station or obtain it through the court.

Step 3 — Contact an advocate immediately. A false FIR case requires immediate legal intervention. Time is critical — especially if the offence is non-bailable.

🏛️ 3. Apply for Bail

If the FIR involves a bailable offence, you can obtain bail directly from the police station. If it is a non-bailable offence, you must apply before the Sessions Court or High Court.

Your advocate will file a bail application and argue that the FIR is false, motivated by malice, and that you pose no risk of absconding. Courts in Pakistan do grant bail in cases of apparent malicious prosecution.

The most powerful remedy against a false FIR in Pakistan is a Quashment Petition filed before the High Court under Section 561-A CrPC read with Article 199 of the Constitution.

If the High Court is satisfied that the FIR is false, frivolous, or an abuse of process, it can:

• Quash (cancel) the FIR entirely
• Stay the investigation
• Direct the police not to arrest you

This is the most effective legal remedy and should be pursued without delay.

⚖️ 5. Take Legal Action Against the Complainant

Filing a false FIR is itself a criminal offence in Pakistan. Under Sections 182 and 211 PPC, a person who files a false complaint or false charge can face imprisonment and fines. Once you have secured your own position, your advocate can file a counter-complaint against the person who filed the false FIR.
