Tenant Eviction Process in Pakistan: Rights of Landlords and Tenants Under Rent Laws

A landlord cannot simply change the locks and throw a tenant’s belongings onto the street — no matter how overdue the rent is. Eviction in Pakistan is a legal process with defined grounds and procedure, and both landlords and tenants often get it wrong.


⚖️ The Legal Framework

Tenancy and eviction are governed provincially — for example the Sindh Rented Premises Ordinance, 1979 in Sindh, and equivalent Rent Restriction laws in Punjab and other provinces. These laws establish a Rent Controller as the forum for eviction disputes, separate from ordinary civil courts.


🚩 Valid Grounds for Eviction

  • Non-payment of rent despite notice
  • Personal bona fide need of the landlord or their family for the premises
  • Subletting without the landlord’s written consent
  • Material damage to the property caused by the tenant
  • Using the premises for a purpose other than what was agreed (e.g., commercial use of residential property)
  • Expiry of a fixed-term tenancy where renewal is refused

📋 Step-by-Step Eviction Process

  1. The landlord must issue a written notice to the tenant specifying the ground for eviction and a reasonable time to remedy or vacate.
  2. If the tenant does not comply, the landlord files an eviction application before the Rent Controller of the relevant jurisdiction.
  3. Both parties are given the opportunity to present evidence and arguments.
  4. The Rent Controller passes an eviction order if the ground is proven.
  5. If the tenant still does not vacate, the landlord can seek execution of the order through the Rent Controller’s office — self-help eviction (changing locks, removing belongings) is illegal and can expose the landlord to criminal and civil liability.

Practical example: If a landlord needs the property back because a son is getting married and requires the house, this qualifies as “personal bona fide need” — but the landlord must still prove genuineness of the need before the Rent Controller, not simply assert it.


⚡ Tenant Protections

  • A tenant cannot be evicted without due process, even for non-payment — a notice and opportunity to pay/respond is required.
  • Tenants can contest the eviction application and present their own evidence before the Rent Controller.
  • An eviction order can be appealed to the relevant appellate forum within the prescribed limitation period.

  • Landlords should always have a written tenancy agreement specifying rent, term, and permitted use of the property.
  • Never resort to self-help eviction — it can result in criminal charges against the landlord.
  • Tenants should keep proof of rent payments (bank transfers, receipts) to defend against false non-payment claims.
  • Both parties should retain copies of all notices sent and received, with proof of delivery.
