What is the Rule of Law?

Bingham identifies eight sub-rules that together constitute the rule of law:

• Questions of legal right should be resolved by law, not discretion
• The law must apply equally to all — including government officials
• Ministers and public officers must exercise their powers in good faith and within their limits
• Human rights must be protected
• Disputes must be resolvable without excessive cost or delay
• The courts must adjudicate fairly
• The state must comply with its obligations in international law

Why It Matters in Pakistan

Reading this book as a Pakistani lawyer gives it particular resonance. Each of Bingham’s eight principles represents both an aspiration and a challenge in our legal system. Understanding what the rule of law truly requires helps advocates identify where it is being upheld and where it is being violated.
