You want to sublet a room or your entire rented flat β perhaps you are travelling temporarily, need to share costs, or have a legitimate personal reason. The question is: is this legally permissible? And does your landlord need to know? The answers lie in your tenancy agreement and in Pakistani rent law β and getting them wrong can cost you your deposit, your tenancy, and more.
βοΈ 1. Legal Framework
Subletting in Pakistan is governed by:
- Sindh Rented Premises Ordinance, 1979 (SRPO) β applicable in Karachi and Sindh
- Punjab Rented Premises Act, 2009 β applicable in Punjab
- Transfer of Property Act, 1882 β Section 108 β defining tenant rights and duties
- Contract Act, 1872 β governing the consequences of agreement breach
- Your Tenancy Agreement β which sets out the specific terms agreed between landlord and tenant
π 2. The General Rule β Landlord Permission is Required
Under Pakistani law, the general rule is that a tenant cannot sublet rented premises without the landlord’s consent. The reasoning is straightforward: the landlord entered into the tenancy agreement with you specifically β on the basis of your identity, your responsibility, and your agreement to the terms. Introducing a third party without consent constitutes a breach of that agreement.
Under Section 108(j) of the Transfer of Property Act, 1882, a tenant has the right to use and enjoy the property β but the right to transfer or sublet is restricted unless the landlord’s consent has been obtained.
π 3. Read Your Agreement First
Before taking any action, carefully read your tenancy agreement. There are three possible situations:
Situation 1: The Agreement Says “No Subletting”
If your agreement contains a clause prohibiting subletting β such as “the tenant shall not sublet or assign the premises” β then subletting is absolutely not permitted under any circumstances. Doing so would constitute a direct breach of contract and grounds for eviction.
Situation 2: The Agreement Permits Subletting
If the agreement explicitly allows subletting, you may proceed. However, you must still execute a separate written agreement with your subtenant. Remember: regardless of who occupies the property, you remain fully responsible to the original landlord for rent, maintenance, and all obligations under your tenancy agreement.
Situation 3: The Agreement is Silent on Subletting
If the agreement does not address subletting at all, do not assume it is permitted. Obtain written permission from your landlord first. Do not rely on a verbal agreement β if a dispute arises later, a verbal permission is extremely difficult to prove.
β Example: Sara rented a flat and sublet one room to a friend without informing her landlord. Her agreement said nothing about subletting. The landlord discovered this three months later, treated it as a breach of contract, and filed an eviction petition with the Rent Controller. Sara also lost her security deposit.
π¨ 4. Consequences of Subletting Without Permission
If you sublet without the landlord’s consent, you face the following legal consequences:
- Breach of contract β the tenancy agreement is violated, giving the landlord grounds for legal action
- Eviction proceedings β the landlord can file an eviction petition with the Rent Controller
- Forfeiture of security deposit β the landlord may legally withhold your deposit
- Civil suit for damages β the landlord can sue for any loss suffered as a result of the unauthorised subletting
- Criminal liability β in extreme cases, charges of cheating or criminal breach of trust may apply
π 5. If You Have Permission β What Should the Subletting Agreement Include?
Once you have the landlord’s written permission, execute a proper written subletting agreement with your subtenant containing:
- Full address and description of the property being sublet
- The subletting period β clear start and end dates
- Monthly rent amount and due date
- Security deposit terms and conditions for refund
- A clear statement that this is a subletting arrangement and that the original landlord’s permission has been obtained
- Signatures of both parties with date
- A copy of the original landlord’s written permission attached
π‘ 6. Practical Tips
- Obtaining written permission takes minutes β the legal consequences of not doing so can last years
- Always get landlord permission in writing β a WhatsApp message confirming permission is better than nothing, but a signed letter is best
- Keep a copy of your subtenant’s CNIC β you are responsible for who occupies the premises
- If you are renewing your tenancy agreement and anticipate needing to sublet in the future, negotiate a subletting clause into the agreement at renewal time
- If you are a landlord and discover unauthorised subletting, serve a formal notice before taking legal action
